HexCore provides virtual infrastructure and related cloud services subject to these Terms of Service.
By creating an account or using the service, the customer confirms that they are authorized to enter into a binding agreement.
The customer is responsible for keeping account credentials confidential and for all actions performed through their account.
Rights and Obligations of the Parties
The Lessor undertakes to:
Provide the Lessee with temporary use of the server, in accordance with the technical resources specified in the pricing plans.
Provide technical support services for the server.
Ensure constant 24/7 connection of the server to the Internet.
Notify Lessees of any changes to current service rates at least 10 days in advance through the Lessor's website on the Internet.
The Lessor has the right to:
Change the composition of services provided, pricing plans, and other terms of the agreement no more than once per quarter.
The Lessee undertakes to:
Use the server only for its intended purpose.
Return the server in a timely manner upon expiration of this Agreement.
Use the server for the purpose of hosting resources and websites on the Internet.
Independently protect from disclosure the administrative login and password assigned to them, which constitute confidential information. In case of disclosure of this information, the Lessee is fully responsible for all actions performed under their name and password by themselves or by third parties. The Lessor is not liable to the Lessee for any damage of any kind incurred in connection with the loss of their server access credentials.
Ensure backup of data stored on the server.
Use the Lessor's services only in a lawful manner and not hold the Provider liable for any damage of any kind incurred by the Lessee or third parties during the Lessee's use of the Lessor's services.
Indemnify the Lessor, including financially, from claims of third parties, if such claims are made.
Not use the virtual server for activities prohibited by applicable law, including for the distribution of spam (including search spam) or actions contributing to its distribution.
Not perform actions that may result in: disruption of the correct operation of equipment, software, networks not belonging to the Lessee; unauthorized access to information and computing and network resources not belonging to the Lessee; causing or threatening to cause damage to any Internet users; misleading third parties regarding the source of information; destruction or modification of software or data not belonging to the Lessee without the consent of their owners; scanning of information and computing and network resources not belonging to the Lessee.
Not host or run on the Lessor's resources: game servers, mining software, Internet anonymization software except for personal and corporate VPN servers.
The Lessee has the right to:
Receive necessary and reliable information about the Lessor, their operating hours, and services provided.
Demand recalculation of funds up to full refund of amounts paid for services due to provision of services of inadequate quality.
Apply to the Lessor for refund of funds paid as advance payment.
Additional Terms and Conditions
Provision of services to the Lessee may also be suspended if, in the Lessor's reasonable opinion, the Lessee's use of the Services may cause damage to the Lessor and/or third parties, as well as in case of provision of inaccurate data by the Lessee when accepting the offer (registration on the Lessor's website).
Rental Fee and Payment Terms
The monthly rental cost is determined based on actual use of the Service, in accordance with the rates specified on the main page of the website.
The Lessee undertakes to pay the Lessor the rental fee for the use of the virtual server.
The initial one-time payment for virtual server setup is 0 (zero).
The Lessee pays for services monthly as 100% prepayment. Payment must be made no later than the start date of the next service period (billing date specified in the invoice) for which payment is made. If the Lessee has not paid for the Service, the Lessor has the right to suspend access to the Service. To restore service provision, the Lessee must pay for the entire period, including the period when the service was suspended.
In case of non-issuance or untimely issuance of an invoice by the Lessor, the Lessee is released from liability for violation of payment terms under this Agreement.
The average channel utilization per month per server shall not exceed 100 Mbit/s, except for the Mini plan, where channel utilization shall not exceed 10 Mbit/s. Channel utilization is calculated using hourly averaging. In case of exceeding the average channel utilization, a shaper is applied at 100 Mbit/s, and for the Mini plan at 10 Mbit/s. Upon customer request, the channel width can be expanded for an additional fee, which is calculated individually.
Services provided by the Lessor shall be deemed fully performed and accepted in the absence of written objections or claims from the Lessee within 10 days after the end of the billing period.
In case of non-use of the Services by the Lessee (no need for Services, impossibility of receiving Services due to technical or other problems on the Lessee's side), the cost of Services paid by the Lessee is not refunded, and the Service is deemed to have been provided in full.
In case of violation of the rules of use of the Service and the Lessee's refusal to eliminate the specified violations, refund is possible only if the account balance exceeds the amount necessary for payment of the current period.
Liability
The Lessor's liability, if any, is limited to the amount of actual damage and cannot exceed the cost of the monthly subscription fee under this Agreement.
The Lessor is not liable for possible failures and availability of the Service through the Lessee's communication channels.
The Lessor is not liable for possible failures and availability of the Service due to failures in the data center operation.
The Lessor is not liable for direct and/or indirect damages incurred by the Lessee as a result of using the services under this Agreement.
The Lessor is not liable for the content of information placed by the Lessee.
